Rental Policy
This contract is between PARKER EQUIPMENT RENTAL LLC (the “OWNER”) and ___ (the "RENTER”).
Safe, Experienced Operation – Trailer Rental
RENTER hereby states they have adequate experience towing a trailer and feel 100% comfortable operating a vehicle with the rented trailer and load attached. RENTER understands how to weigh loads and will not overload the trailers stated capacity/GVWR. RENTER also states they know basic trailer connection, operation, safe driving practices while towing, and disconnection (if applicable). RENTER also states they know how to properly inspect both the trailer and load prior to operation, as well as how to properly secure and transport loads.
Safe, Experienced Operation – Equipment Rental
RENTER hereby states they have adequate experience operating the rented equipment and feel 100% comfortable safely operating it both empty, under load, and in the environmental conditions they will be using it in. RENTER understands how to weigh loads and will not overload the equipment's stated/rated operating capacity. RENTER also states they know best safety practices and how to make the worksite safe for themselves, other workers, bystanders, and the equipment. RENTER also states they know how to properly inspect the equipment prior to operation.
Usage & Past Due
Machinery rentals come with 8 hours per day of engine run time. Use over 8 hours per day will result in $25/hour overage fee’s. A rental is considered past due if not returned by the due date and time listed on the rental contract. A daily rental is considered from start of the day, to that same time the next day (24 hours). There is a 2 hour grace period, after that late fee’s ($25/hr) begin immediately. After 4 hours late, a full ADDITIONAL daily rate is charged. If a return is 3 hours and 15 minutes late or more, a minimum of 2 late hours will be charged.
Care & Cleaning
Our rental rate structure anticipates all equipment be returned clean, or additional charges will be made. RENTER hereby agrees that they will return their rented item/s clean and in reasonable condition for it's next rental. This includes but is not limited to the deck, floor, sides, windows, structural components, fenders, wheels, tires; and all straps, buckets, winch lines, cables, or other accessories provided with the rental. Failure to return equipment in clean, "ready-to-roll" condition that is the same or better than at the start of their rental will result in a cleaning fee beginning at $50. However, in the event of inclement weather RENTER is not expected to clean equipment, or when otherwise given permission from the OWNER on a case-by-case basis (example; job-site does not have provisions to clean the equipment AND renter notifies OWNER of this PRIOR to the start of the rental). RENTER should still return all straps, winch lines, cables, or other accessories provided with the rental in an organized, well kept, "ready-to-roll" condition or charges may still apply.
Cancellation, Rescheduling, Returns
We will make every effort to accommodate rescheduling needs as they arise. We ask that you please notify us at least two days in advance of your need to reschedule. Any reservation rescheduled without at least 48 hours notice MAY incur a $50 rescheduling/cancellation fee for their original date. This will be evaluated on a case by case basis.
If rescheduled more than once; or within 24 hours of the rental scheduled start the rental is rescheduled or cancelled, the $50 fee will be non-negotiable to cover losses.
A “No-Call No-Show” will be charged a non-negotiable $75 fee to cover lost time and rental income.
ALL Rentals are billed for time OUT, not time USED. No refunds will be made for any rented equipment, trailer, or item/s once delivered, even if it is claimed not to have been used. This same policy of no refunds also applies to early returns of daily and/or period (weekly, monthly, etc) rentals.
NO SMOKING
NO SMOKING! Under NO circumstance is smoking, vaping, using e-cigarettes, or similar allowed in any rental equipment. Any odor, ash, butts, or similar evidence of smoking in rental equipment will result in a non-negotiable $150 cleaning fee. If RENTER has concerns about odor or other smoking evidence, this must be addressed and documented at the beginning of the rental, otherwise renter will be held responsible.
Fuel
RENTER hereby agrees to the following:
Your machine will arrive "Full" on fuel. MOST of our machines are Diesel-powered, but not all. You do not have to refuel your machine at the end of your rental. We will fuel the machine after your rental and bill you a flat rate fee of $5.25/gallon. If you choose to self-refill, please ensure and double check you are using the correct fuel. If you accidentally use the wrong fuel DO NOT start the machine and contact us immediately. If you use the wrong fuel you will be charged a non-negotiable $250 fine in addition to downtime, full repair costs, transportation, and any other associated expense/damages as outlined in the above contract
Tires – Damage / Flat Tires / Etc
PLEASE BE SURE TO PROPERLY ADJUST BRAKE CONTROLLERS BEFORE OPERATING A TRAILER. Not only is this a safety issue, but excessive braking significantly contributes to tire wear and/or failure. Any “flat spots” will require complete tire replacement and RENTER will be billed for such. This applies even if the rest of the tire is acceptable.
Before operating the rented equipment, trailer, or item/s check the site for debris or terrain that could cause damage to the item/s or tires. Be aware of roadway or worksite debris and/or damage that could cause damage to the rented item/s. In most instances, damage to tires is caused by conditions of a job/work site, roadway, or striking objects (such as curbs, rebar, and holes) during use. As such, payment for ALL tire replacement is considered the responsibility of the RENTER, unless otherwise proven. In the event of a flat tire, the customer must call OWNER for repair. Again, tire repair is at customer's expense in almost all cases. PARKER EQUIPMENT RENTAL LLC does NOT repair tires, ever. ANY damage will result in full replacement due to safety concerns. OWNER is NOT responsible for any and all tire damage, wheel damage, similar, or less during the rental period. Please inspect tires prior to rental for good operating condition.
Service Call fee's apply as described below for any and all tire repair, replacement, or similar unless there is irrefutable evidence that the tire incident was at no fault of RENTER.
Tracks – Damage / Derailment / Etc
PLEASE BE SURE TO PROPERLY CHECK AND ADJUST THE TENSION ON TRACK IDLERS DAILY BEFORE BEFORE OPERATING THE MACHINE. If you have questions on this, please ask!!! Not only is this a safety issue, but with use track idlers may become loose which significantly contributes to derailment, wear, and/or track failure. Any and all damage, derailment, or similar of the track is ALWAYS found at the responsibility of the RENTER unless there is irrefutable evidence that the incident was at no fault of RENTER.
Before accepting delivery of, or leaving PARKER EQUIPMENT RENTAL LLC property please check the condition of the tracks and address ANY concerns with a PARKER EQUIPMENT RENTAL LLC representative. Once your rental begins ANY and ALL damage, derailments, or similar event to the tracks is considered RENTER's responsibility. Before operating the rented equipment or item/s check the site for debris or terrain that could cause damage to the item/s or tracks. Be aware of roadway or worksite debris and/or damage that could cause damage, derailment, or similar to the rented item/s. In almost all instances, damage to tracks is caused by conditions of a job/work site, roadway, operator error, or striking objects (such as curbs, rocks, rebar, and holes) during use. As such, payment for ALL track replacement, realignment, or similar is considered the responsibility of the RENTER, unless otherwise proven. In the event of a broken track, derailment, or similar, the RENTER must call OWNER for repair. Again, track repair is at customer's expense in almost all cases. PARKER EQUIPMENT RENTAL LLC does NOT repair tracks, ever. ANY significant damage will result in full replacement due to safety and reliability concerns. OWNER is NOT responsible for any and all damage to the track, idler, gears, drive assembly, similar or less during the rental period. Please inspect tracks and aforementioned assemblies prior to rental for good operating condition.
Service Call fee's apply as described below for any and all track repair, replacement, or similar unless there is irrefutable evidence that the tire incident was at no fault of RENTER.
Concrete
ANY CONCRETE OR SIMILAR MATERIAL ALLOWED TO DRY/HARDEN ON THE MACHINE, BUCKETS, WHEELS, OR ANY OTHER SURFACE WILL RESULT IN A MINIMUM OF A $250 FEE IN ADDITION TO CLEANING AND/OR REMOVAL FEE’S.

Weight Capacity
RENTER shall inspect the rented equipment, trailer, or item/s; their load; and all listed weight ratings, capacities, and markings to ensure they are not over the rated and/or legal weight limits. RENTER shall follow all DOT, state, and federal laws regarding weight limits and transport regulations. If RENTER has any questions regarding the weight capacity or limits of their rented item/s, they must contact OWNER immediately for clarification. Under no circumstance is overloading acceptable or legal.
I RENTER, acknowledge this and my responsibility for any damages or losses associated with exceeding the weight capacity of a trailer. RENTER also acknowledges a non-negotiable $250 fee for any discovered evidence or electronic alert of overloading. All equipment is monitored 24/7 via GPS. Equipment may be equipped with pressure and weight sensors inside the tires and/or suspension that remotely monitor location, speed, tire weight/load, and tire pressure.
Speed Limit
RENTER herby agrees not to exceed the posted speed limit OR 65 MPH, whichever is less, while in tow with a trailer or rented equipment. Under no circumstance shall a rented trailer or while towing OWNERS equipment exceed 65 MPH. RENTER acknowledges the increased risk of crashes and damage while speeding with a trailer in tow. Additionally, RENTER acknowledges the safe speed rating of trailer tires is not the same as vehicle tires, and severely limits the safe maximum speed of the trailer. All equipment is monitored 24/7 via GPS and may be equipped with speed alerts to OWNER.
Roadway Tolls
The RENTER agrees not to utilize any Express Lanes, Toll Roads, or other charged-per-use roadways (“Toll roads") during the rental period. Should the RENTER use toll roads, they will be solely responsible for any fees or charges incurred as a result of such usage in addition to a non-negotiable $50 fee. The Renter acknowledges that all tolls must be paid promptly and agrees to reimburse OWNER for any toll-related charges and the usage fee that may be billed to the Company after the rental period. Failure to comply with this provision will result in additional fees and penalties, billed at 2x the rate compounded weekly until paid.
Service Calls
RENTER hereby understand the following “Service Call” Fee Schedule
• Mechanical Breakdown, Equipment Failure, or Similar: No Fee
• After Hours: No Additional Fee
• Operator Error, Operator Damage, False Call, or Similar: $125/hour + $3.50/mile from PARKER EQUIPMENT RENTAL LLC “HQ”
• After Hours: Additional $100
OWNER hereby agrees to make themselves readily available by phone, during normal business hours; for technical advice, guidance, troubleshooting, and similar. If RENTER is unable to problem solve via phone and request field service/visit/guidance the fee is IMMEDIATELY applied. If RENTER advises they were operating their rental equipment and caused damage needing immediate repair, the fee is IMMEDIATELY applied. Once applied the fee is irrevocable for any circumstance, outside of discovery that the issue was in fact at no fault of the renter/operator. In the event of a “Turn Around” or cancel request after the service call has been dispatched RENTER shall pay actual mileage driven, plus 10%. There is a minimum 10 mile fee.
Example: 1- Renter is attempting to use a winch on a trailer, but fails to turn on the battery isolating switch, and requests field service. The dispatch representative or mechanic has driven 15 miles and Renter attempts to cancel after turning on the switch. Renter will pay $125 + $57.75 (16.5 miles).
2- Renter is operating a skid steer and an mechanical code displays on the machine. Renter contacts PARKER EQUIPMENT RENTAL LLC and they dispatch a representative and/or mechanic. The responding representative arrives and discovers the code is of mechanical nature and of no fault of the renter. There is NO fee.
You Break It, You Buy It
For all intents and purposes, the saying "you break it, you buy it" applies to all damage encountered during a rental. This includes parts, labor, and downtime for the rental item.
PARKER EQUIPMENT RENTAL LLC is not responsible for any repair costs, loss of use, or other damages you cause during your rental period. This however, does not include, normal wear and tear such as paint damage.
Damage Costs
The RENTER shall pay the OWNER full compensation for full repair costs including but not limited to: parts, labor, and full “downtime” costs, of any equipment, trailer, or other rented item/s which is damaged and in need of repair to put it into the same condition it was in at the time of rental. This excludes customer liability from existing damage and a reasonable amount of “normal” wear and tear, such as paint scratches.
The OWNER’s invoice for replacement or repair is final and conclusive as to the amount RENTER shall pay for repair or replacement.
If during your rental period the equipment, trailer, or other rented item/s is damaged, lost, stolen, or any other loss/claim rendering it out of service for any amount of time, there will be an automatic, non-refundable, non-negotiable $200 administrative fee; in addition to service call fee's as applicable.
Responsibility for Damage or Loss/Theft; Reporting to Police.
RENTER is responsible for all damage to, loss, or theft of the trailer. This includes damage caused by weather, road conditions, others, and acts of nature; regardless if you are or are not at fault. As such, the RENTER shall pay the OWNER full compensation for the replacement value of any equipment, trailer, or item/s rented which is not returned because it is totaled, lost, or stolen.
You (RENTER) are responsible for the cost of repair or the actual current market replacement value of the equipment, trailer, or item/s rented if it is not repairable or if we deem it unrepairable due to safety. You are responsible for Loss of Use/Downtime, Diminished Value, missing equipment or parts, and a reasonable charge to cover our administrative expenses connected with any damage claim.
You must report all accidents involving any equipment, trailer, or item/s rented to us within 1 hour of occurrence or discovery. In the event of theft you must report all occurrences to the police within 15 minutes of discovery. Failure to do so will result in immediate RENTER liability for replacement.
Legal Operation
The RENTER shall inspect and abide by all payload and weight capacities listed on any equipment, trailer, or item/s rented. If required RENTER will possess all required licenses, insurances, and other items before operating the rented item/s. RENTER will only park and operate the rented item/s where legally allowed. The RENTER is responsible for any and all traffic citations, impound fee’s, environmental fee’s, or any other fee’s occurred during their use.
Location on Demand
The RENTER shall inform the OWNER upon demand, of the exact location of the equipment, trailer, or item/s rented at any time while it is in the RENTERS’ possession. No equipment, trailer, or item/s rented are to be taken outside the State of Colorado without prior WRITTEN consent from PARKER EQUIPMENT RENTAL LLC (the “Owner”).
Right to Retrive
If the RENTER is in default of any of the terms and conditions of this agreement, or fails to return, or provide the location on demand; the OWNER, and/or his agents, and/or law enforcement at the RENTER’s risk, cost, and expense may at any time enter the RENTER’s premises, private property, or worksite where the rented item/s is and recover it. RENTER hereby waives any rights to privacy or trespass claims during this retrieval event.
Abandonment
If RENTER abandons the equipment, trailer, or item/s rented for any reason, there will be a non-negotiable $250 fine. RENTER is still responsible for ALL damage, theft, loss, or other incidents involving the rented item/s if abandoned until returned or retrieved by the owners. If you must leave the rented item/s outside of your possession, you must contact OWNER immediately and get written permission to do so. It must be left in a safe place and fully secured. Permission to abandon is very rare and evaluated on a case-by-case basis, often only granted for life safety.
License Plate
Under no circumstance shall the license plate from the rented item/s be removed, covered, altered, placed on a different vehicle, or otherwise manipulated in any fashion. If a license plate is removed, lost, misplaced, or stolen during your rental there is a non-negotiable $75 replacement fee.
Owner Released of all Damages/Liability
RENTER indemnifies and holds OWNER harmless for all injuries or damage to their person, property, worksite, or others and their respective property during the use of the rented equipment, trailer, or item/s.
RENTER indemnifies and holds OWNER harmless for all injuries or damages of any kind for repossession/retrieval, impound, or other seizure and shall pay for all consequential and special damages and financial costs for any such event.
Renter Shall Secure Loads
RENTER is responsible for securing all loads and items placed in/on their trailer. RENTER is responsible for securing and knowing the path of all loads and items placed in/on or moved by/with rented equipment. RENTER is responsible for securing all gates, nets, latches, chains, safety’s, pins, or other installed devices on the equipment, trailer, or rented item/s prior to use. RENTER agrees to follow all DOT standards and both state/federal law's when loading, unloading, securing, and transporting loads or equipment. RENTER is responsible for damage or loss to any items placed, transported, or otherwise used in/on the trailer or equipment. RENTER is responsible for any damage or loss of any rented equipment/item they are transporting during it's transportation. This includes damage caused by weather, road conditions, others, and acts of nature; regardless if you are or are not at fault. RENTER is responsible for a complete safety inspection of the trailer, tires, hitch, chains, straps, contents, and/or other items before each use of the trailer.
Operating Condition
We will perform an inspection WITH you prior to rental start. Any damage, operation deficiency, or other issues found after this inspection will be considered to have happened during your rental period and are your responsibility. In the event that the equipment you've rented is not operating as it should or has a problem, please contact us immediately. Continuing to run the equipment, trailer, or rented item/s with a malfunction can cause excess wear, tear, and damage; and you will be liable for this. This will also result in extra time spent attempting to complete your project. Please help us take care of our equipment, and help you get your projects done properly by addressing any and all malfunctions or problems as soon as they occur. If you do not call to inform us of the problem with the equipment and wait to inform us, or we find it, when you return the equipment upon it being scheduled due, you will be held responsible for the full cost of the rental unit downtime, repairs required to return it to operational condition, or replacement.
Identification & Insurance –
Renting from PARKER EQUIPMENT RENTAL LLC requires identification on all rentals as follows:
1. Valid USA driver's license, Military ID, or USA State ID card
• ONLY the person who’s driver’s license is on file may tow or transport the rented equipment. Under NO circumstance is any deviation from this allowed.
2. Year, make, and license # of renter's tow vehicle. (IF towing)
3. Proof of full-coverage insurance. (IF towing)
Reservations
It is always a good idea to reserve the rental item in advance. All reservations will be held for 30 minutes after your scheduled appointment time. After that your reservation is void and we may rent out your selected equipment to someone else. We are happy to change your time with at least 3 hours notice. Some reservations require a deposit. PARKER EQUIPMENT RENTAL LLC may not have all rental items in stock. Most can be reserved upon return for your convenience with an advance reservation.
All prices are subject to change without notice.
Holiday Rental Rates
Rental rates are generally charged based on the amount of time the item/s are out, not time used. However, as we are closed on all major Holidays, unless otherwise expressed in writing, trailers picked up the day before a holiday will be charged 1 1/2 days if you would be returning the unit on the Holiday.
Overnight Rates
In order to qualify for an overnight rate, you must pick up the trailer during the last hour of business and return it during the first hour of business the following day
Authorized Agents
Customers may send authorized agents to rent equipment on their behalf. Your authorized agent must be 18 years-of-age or older per our company policies. If you have not arranged for prepayment prior to the rental, your authorized agent must use their personal credit or debit card to pay the deposit. We will never accept your card if you are not present. Name on card and name on ID MUST match. In the event, you have not rented from us before; we ask that you set up the rental ahead of time in person at our store for identification purposes. Once you have been set up in our system, you may call the store to prepay and set up the rental for your authorized agent to pick up.
Your Authorized Agent must have a valid Driver’s License and Insurance.
Towing/Vehicle Requirements
Based upon information provided by insurance sources indicating a high correlation in accidents/claims involving short-wheelbase tow vehicles and tandem axle trailers we recommend the following guidelines:
- Tandem axle trailers, including tow dollies, require a tow vehicle with a minimum wheelbase of 120 inches. The wheelbase measurement being made between the front and rear axle centers. This will also apply to towed trailers with a gross vehicle weight (GVW) in excess of 2000 lbs. - In addition, our larger/heavier trailers will require a “3/4 ton” or larger chassis. Most 24' or larger trailers require a minimum 3/4-ton, full size, domestic pick-up truck with a 133 inch minimum wheelbase. Notable exceptions to this are the Ford Excursion and ¾-ton Chevrolet Suburban meeting the minimum wheelbase requirements.
PARKER EQUIPMENT RENTAL LLC reserves the right to deny use of any vehicle we feel may not be appropriate or safe.
Hitch Requirements
An adequate hitch is also necessary. The hitch must be rated for at least 1.25x the total combined GVWR of the trailer. For tandem axle trailers and all trailers greater than 3500 lb. GVWR, a minimum class 3 receiver-type hitch is required. A hitch or bumper is rated to its capacity, not that of the vehicle, and either may be less. A single-piece, solid, machined ball, with proper shank diameter must be used. Non-rated bushing or shims to increase the shank size shall not be used.
Delivery Policies
Call ahead to make arrangements (for an additional fee) to have one of our drivers deliver the rental right to you. Our drivers also take the time to show the basic operating functions of the rented equipment, trailer, or item/s before heading off on their next run. Delivery charges are subject to change and in many cases based on the distance of the delivery site. Rental rates on delivered trailers are a minimum 1-day charge. The customer must call to request pickup when completed unless a time is prearranged. PARKER EQUIPMENT RENTAL LLC does not automatically pick up when the rental is scheduled to end. Failure to call or arrange for pick up on time will result in additional charges for rental.
Card on File
I, RENTER, hereby authorize the business (PARKER EQUIPMENT RENTAL LLC) to keep my credit card on file for any future transactions, no-show, cancellation, late fee's, damage during my rental, or other loss from the business associated with my reservation/rental.
I understand that the terms of this authorization will remain in effect. I acknowledge that I am responsible for making any change to the card on file or cancellation of file requests in writing.
Additional Rental Terms
1. The RENTER shall keep, maintain, and be responsible for the rented item/s during the terms of the rental period at the customers own cost and expense. Customer shall keep the item/s in a good state of order during the rental period.
2. The rented item/s shall be delivered to RENTER and returned to OWNER at the RENTER’s risk, cost, and expense if they chose not to use the OWNER’s delivery/pickup service.
3. Periodic rental rates are charged by OWNER and billed to the RENTER for each period of time from the time the item/s is delivered to RENTER until its return. If a term rental rate is charged by OWNER, rental charges are billed to the RENTER for the full term even if the item/s is returned before the end of the term. If the item/s is not returned during or at the end of the term, then late charges stated shall be charged on a constant and hourly or daily basis until the trailer is returned. After 4 hours late, a full daily rate is charged.
3. No refunds will be made for any rented equipment, trailer, or item/s once delivered, even if it is claimed not to have been used. Acceptance of a returned item/s by OWNER does not constitute a waiver of any of the rights OWNER has under the rental agreement.
4. The RENTER shall not pledge, sell, or encumber the rented equipment, trailer, or item/s in any way. The OWNER may terminate this agreement immediately upon the failure of RENTER to make rental payments when due, or upon RENTER’s filling for protection from creditors in any court of competent jurisdiction.
5. The OWNER makes no warranty of any kind regarding the rented equipment, trailer, or item/s, except that OWNER shall replace the rented equipment, trailer, or item/s with identical or similar if the item/s fail to operate in accordance with the manufacturer’s specifications and operation instructions. Such replacement shall be made as soon as practicable after RENTER returns the non-conforming item/s. If a replacement is not available a full-refund will be issued and/or the rental rescheduled.
6. These terms are accepted by the RENTER upon delivery to the RENTER or the agent/other representative of RENTER.
Definitions
For the purpose of this contract and all other forms, contracts, and paperwork regarding business with PARKER EQUIPMENT RENTAL LLC, the terms PARKER EQUIPMENT, PARKER RENTAL; The Owner/Owners/OWNER; or any other term suggesting to business or it's owners may be used interchangeably and should be considered one-and-the-same.
Additionally the terms, “you”, Renter, Client, RENTER, or any other terms implying the person renting the equipment, trailer, or item/s should be considered as one-and-the-same, being the person responsible for and renting the item/s.
Bulletins/Summary
- I, RENTER, have read and agree to all terms, policies, and conditions outlined in the above agreement.
- I, RENTER, agree to operate the rented equipment, trailer, or item/s legally, responsibly, and safely at-all-times.
- I, RENTER, agree to keep watch and security of the rented equipment, trailer, or item/s during my use.
- I, RENTER, agree to perform a safety inspection of the rented equipment, trailer, or item/s; and load, prior to each use.
- I, RENTER, agree to secure the rented equipment, trailer, or item/s; and all loads, prior to transport in a proper manor and consult professional help if I am unsure if it is secure or safe to transport. I understand that OWNER may give experience-based advice on securing but is not considered a subject matter expert or transportation/load securing professional and I, RENTER, am ultimately liable and responsible.
- I, RENTER, understand the OWNER is not responsible for the safety and security of the items for which I am hauling and release OWNER from all liability of any damages or loss to the property being transported.
- I, RENTER, agree to only use the tow vehicle and driver outlined in the rental agreement as it is the one (and person/s) inspected, recorded, and approved by the OWNER.
- I, RENTER, release the OWNER from all liability and am solely responsible for any costs, and damages occurring secondary to damage, theft, loss, injury, property damage, or other factors during my use and rental of the rented equipment, trailer, or item/s.
Signatures
This contract may be signed electronically or in hard copy. If signed in hard copy, it must be returned to or scanned by the Business for valid record. Electronic signatures count as original for all purposes. By typing or e-signing their names as signatures below, all parties involved agree to the terms and provisions of this entire agreement as applicable to their rental. Approval of the estimate or payment of the invoice constitutes digital signature and acceptance of the terms and conditions of this rental policy.
